FREQUENTLY ASKED QUESTIONS (RISK)"},"content":{"rendered":"\n<p>The following FAQs are specific to Insurance and Risk Management<\/p>\n\n\n\n<p><em>A comprehensive FAQ guide related to youth programs can be found at <\/em><a href=\"https:\/\/youth.oregonstate.edu\/FAQ\"><em>youth.oregonstate.edu\/FAQ<\/em><\/a><\/p>\n\n\n\n<h4 class=\"has-text-color wp-block-heading\" style=\"color: #d73f09\">Who is a &#8220;volunteer&#8221;?<\/h4>\n\n\n\n<p><strong>A volunteer is a person that:<\/strong><\/p>\n\n\n\n<ul class=\"wp-block-list\"><li> <ul><li>OSU appoints in writing to perform official OSU business; and<\/li><li>Receives no remuneration for his\/her services to OSU; and<\/li><li>OSU receives the primary benefit from the work performed by the volunteer; and<\/li><li>Performs activities at the request of, for the benefit of, and under the supervision of, the university. <\/li><\/ul><\/li><\/ul>\n\n\n\n<h4 class=\"has-text-color wp-block-heading\" style=\"color: #d73f09\">Are volunteers considered &#8220;agents of OSU&#8221;?<\/h4>\n\n\n\n<p>ORS 30.285(1) says: &#8220;A public body will defend, save harmless and indemnify any of its officers, employees <strong>and agents<\/strong>&#8230; arising out of an alleged act or omission occurring in the performance of duty.\u201d<\/p>\n\n\n\n<div class=\"wp-block-group\"><div class=\"wp-block-group__inner-container is-layout-flow wp-block-group-is-layout-flow\">\n<p><strong>OSU volunteers are considered agents of the university so long as:<\/strong><\/p>\n\n\n\n<ul class=\"wp-block-list\"><li style=\"list-style-type: none\">\n<ul>\n<li>The volunteer is working on an OSU task assigned by an authorized OSU supervisor.<\/li>\n<li>The volunteer limits their actions to the duties assigned in a clearly written position description.<\/li>\n<li>The volunteer performs their assigned tasks in good faith, and does not act in a manner that is reckless or with the intent to unlawfully inflict harm to others.<\/li>\n<\/ul>\n<\/li><\/ul>\n\n\n\n<div class=\"wp-block-group\"><div class=\"wp-block-group__inner-container is-layout-flow wp-block-group-is-layout-flow\">\n<p><strong>The university would not consider volunteers agents of OSU under the following circumstances:<\/strong><\/p>\n\n\n\n<ul class=\"wp-block-list\"><li style=\"list-style-type: none\">\n<ul>\n<li>The volunteer is serving only their own interest.<\/li>\n<li>The volunteer is only serving the interest of another organization.<\/li>\n<li>The volunteer is clearly operating outside the scope of their duties.<\/li>\n<\/ul>\n<\/li><\/ul>\n<\/div><\/div>\n<\/div><\/div>\n\n\n\n<h4 class=\"has-text-color wp-block-heading\" style=\"color: #d73f09\">What protection does OSU afford a volunteer?<\/h4>\n\n\n\n<div class=\"wp-block-group\"><div class=\"wp-block-group__inner-container is-layout-flow wp-block-group-is-layout-flow\">\n<div class=\"wp-block-group\"><div class=\"wp-block-group__inner-container is-layout-flow wp-block-group-is-layout-flow\">\n<p><strong>Motor Vehicle Liability<\/strong> <span style=\"color: green\">YES<\/span><\/p>\n\n\n\n<div class=\"wp-block-group\"><div class=\"wp-block-group__inner-container is-layout-flow wp-block-group-is-layout-flow\">\n<p style=\"font-size:14px\">If a volunteer uses a personally owned vehicle in the course of their duties, they are required to have automobile liability insurance to provide primary coverage for any accidents involving that vehicle.&nbsp; The University\u2019s automobile liability coverage may apply on a limited basis only after primary coverage limits have been exhausted.&nbsp; If driving duties are part of the volunteer\u2019s written position description, he or she may request use of an OSU motor pool vehicle.&nbsp; Such requests should be submitted to OSU Transportation Services.<\/p>\n<\/div><\/div>\n<\/div><\/div>\n<\/div><\/div>\n\n\n\n<p><strong>Worker&#8217;s Compensation <\/strong><span style=\"color: red\">No<\/span><\/p>\n\n\n\n<p style=\"font-size:14px\">Workers&#8217; Compensation Insurance is not provided for volunteers at OSU.<\/p>\n\n\n\n<h4 class=\"has-text-color wp-block-heading\" style=\"color: #d73f09\">What other policies are applicable to OSU volunteers?<\/h4>\n\n\n\n<p><strong>Volunteers and Accident Reporting<\/strong><\/p>\n\n\n\n<p style=\"font-size:14px\">Volunteers must immediately report all accidents and injuries to a supervisor.<\/p>\n\n\n\n<p><strong>OSU Conditions of Volunteer Service<\/strong><\/p>\n\n\n\n<p style=\"font-size:14px\">This form must be signed by all volunteers in order for them to be recognized as agents of OSU.&nbsp; This recognition provides the protections noted above. See <a href=\"http:\/\/blogs.oregonstate.edu\/youthsafety\/appendices\/a\/\">Appendix A<\/a> for a link to the form.<\/p>\n\n\n\n<div style=\"height:25px\" aria-hidden=\"true\" class=\"wp-block-spacer\"><\/div>\n\n\n\n<p><em>Additional guidance and resources related to volunteers can be found at <\/em><a href=\"http:\/\/risk.oregonstate.edu\/volunteer\">risk.oregonstate.edu\/volunteer<\/a><\/p>\n\n\n\n<p><a id=\"insurance\" name=\"insurance\"><\/a><\/p>\n<h4 class=\"has-text-color\" style=\"color: #d73f09\">What is &#8220;Camps and Clinics Insurance&#8221;?<\/h4>\n\n\n\n<p>Camps and Clinics Insurance is available to OSU departments and programs that sponsor short-term events and activities involving participants&#8211;typically youth&#8211;who are generally not affiliated with the university. Such events\/activities include but are not limited to youth sports camps, 4-H events, and pre-approved outings.<\/p>\n\n\n\n<h4 class=\"has-text-color wp-block-heading\" style=\"color: #d73f09\"><strong>When does my program need Camps and Clinics Insurance?<\/strong><\/h4>\n\n\n\n<p>You need Camps and Clinics Insurance when:<\/p>\n\n\n\n<p><p style=\"margin-left: 40px\">a)&nbsp; Your program\/event\/activity is <strong>held at OSU<\/strong> <strong>or an OSU facility<\/strong> (e.g., Hatfield Marine Science Center)<\/p><\/p>\n\n\n\n<p><p style=\"margin-left: 40px\">b)&nbsp; Your program\/event\/activity is officially sponsored by OSU and <strong>held at a non-OSU facility <\/strong>(e.g., a school)<\/p><\/p>\n\n\n\n<p><p style=\"margin-left: 40px\">c) &nbsp;Participants are <strong>NOT affiliated with OSU<\/strong> (i.e., they are NOT OSU students, staff or faculty)<\/p><\/p>\n\n\n\n<p><p style=\"margin-left: 40px\">d) &nbsp;Participants are <strong>NOT part of a K-12 school-sponsored program<\/strong> (e.g., NOT on a school-sponsored trip).<\/p><\/p>\n\n\n\n<h4 class=\"has-text-color wp-block-heading\" style=\"color: #d73f09\"><strong>What is the cost for the Camps and Clinics Insurance?<\/strong><\/h4>\n\n\n\n<p>Generally less than $2 per participant or spectator for day programs, or more depending on the length of the activity.<\/p>\n\n\n\n<h4 class=\"has-text-color wp-block-heading\" style=\"color: #d73f09\"><strong>How do I purchase Camps and Clinics Insurance?<\/strong><\/h4>\n\n\n\n<p>Special Event Insurance must be purchased PRIOR\u00a0to the event or activity.\u00a0 To learn more: <a href=\"https:\/\/risk.oregonstate.edu\/camps-and-clinics\">https:\/\/risk.oregonstate.edu\/camps-and-clinics<\/a><\/p>\n\n\n\n<p class=\"has-text-align-right has-small-font-size\">content edited 1-15-2020<\/p>\n","protected":false},"excerpt":{"rendered":"<p>The following FAQs are specific to Insurance and Risk Management A comprehensive FAQ guide related to youth programs can be found at youth.oregonstate.edu\/FAQ Who is a &#8220;volunteer&#8221;?
